Is it possible to collect unemployment benefits while on sick leave? Temporary disability , as we described in the post “ what can be done while on sick leave ”, is a temporary situation in which the worker cannot work, either due to a physical or mental disorder.
If a worker is on sick leave or in a situation of temporary disability, certain doubts may arise as very different situations may arise:
What happens if I am temporarily disabled and am fired?
What if my employment contract ends and I am still on sick leave?
What if I am unemployed and have an accident?

When you are legally unemployed and have an accident or illness, your situation does not change . You continue to receive unemployment benefits even if you are temporarily incapacitated.

If the disability is due to occupational contingencies , the worker will continue to receive the same amount that was paid for temporary disability until he or she is discharged.
Situation after the temporary disability situation has ended
The worker will receive the temporary disability benefit until the date of medical discharge. When the worker is discharged, he or she will be legally unemployed and will have a period of 15 working days to request the benefit.
If the worker has contributed for more than 360 days, he or she will be entitled to unemployment benefits.
If the sick leave was due to a common illness or a non-work-related accident, the amount already received from the end of the contract or dismissal until the date of discharge is deducted from your unemployment benefit. The SEPE (State Public Employment Service) pays the contributions during that time.
If the sick leave was due to an occupational illness or accident at work, the time that the sick leave was paid will not be deducted and the SEPE does not pay Social Security contributions for that time.
The worker does not have enough contributions, but is entitled to receive a subsidy ; nothing will be deducted.
The worker is not entitled to unemployment benefits or subsidies, and the amount received cannot be deducted .
